The Terms

This website (the “Site”) is owned and operated by LemonMD, LLC (“LemonMD”). LemonMD created the Site to provide practical information about cancer to patients, family members and the general public free of charge.  The contents of the Site, such as text, graphics, images, video and other material contained on the Site ("Content") are for informational purposes only, and are not a substitute for personalized treatment and advice from a competent physician.

LemonMD provides the Site to you subject to the following Terms of Service (the “Terms”).  By using the Site, you agree to be bound by the Terms.  LemonMD may, in his sole discretion, modify the Terms without notice to you. Therefore, please continue to review the Terms when using the Site. The last modified date at the top of the Terms will indicate when the latest changes were made. By accessing this Site, you agree to the Terms in effect on each day you access the Site.  In addition, when using particular features on the Site, you shall be subject to any posted guidelines or rules applicable to such features that may be posted from time to time. All such guidelines or rules are incorporated by reference into the Terms.

The Site, including without limitation all Content and all intellectual property rights in and to the same, are owned by or licensed to LemonMD. Except as expressly authorized by LemonMD, you agree not to reproduce, modify, rent, lease, loan, sell, distribute, mirror, frame, republish, download, transmit, or create derivative works of the Content, in whole or in part, by any means.

You are licensed to print a reasonable number of copies for personal/family use but shall not further reproduce or distribute any Content on the Site for any other purpose.

Disclaimer of Medical Liability

The Content of the Site is not designed to, and does not, provide medical advice. The Content obtainable on or through the Site is provided for informational purposes only.  The Content is not intended for use in the diagnosis or treatment of individual conditions or as a substitute for a consultation with a licensed medical professional.

The Content should not be considered complete; is not exhaustive; and does not cover all diseases, ailments, physical conditions, or their treatment. LemonMD does not control or endorse any such third-party websites. You agree that LemonMD will not be responsible or liable for any content provided on or through these outside websites or for your use or inability to use such websites. LemonMD will not be responsible or liable, directly or indirectly, for any actual or alleged damage or loss caused by or in connection with use of or reliance on any such content, goods, or services available on or through any such link or site or from identified medical professionals or their affiliations.

Governing Law 

The Terms shall be exclusively governed by and construed in accordance with the laws of the State of Nebraska within the United States of America without giving effect to any principles of conflicts of law. LemonMD controls and operates the Site from his offices located in the State of Nebraska in the United States of America.  LemonMD makes no representation that the Content contained on the Site is appropriate or available for use in jurisdictions outside the United States, or that the Terms comply with the laws of any other country. Visitors who use the Site  and reside outside the United States do so on their own initiative and are responsible for compliance with local laws, if and to the extent local laws are applicable. If any provision of the Terms shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from the Terms and shall not affect the validity and enforceability of any remaining provisions.

Disclosure of Warranties

YOU EXPRESSLY UNDERSTAND AND AGREE THAT:

BY VISITING THE SITE, LEAVING FEEDBACK OR CONTACTING LEMONMD THROUGH THE SITE, A PHYSICIAN-PATIENT RELATIONSHIP IS NOT CREATED.  THERE IS NO AGREEMENT TO RENDER SERVICES TO YOU OR THAT ANY INFORMATION YOU POST ON THE SITE WILL BE CONDFIDENTIAL.

YOUR USE OF THE SITE IS AT YOUR SOLE RISK UNLESS OTHERWISE EXPLICITLY STATED. THE SITE, INCLUDING ALL CONTENT IS PROVIDED ON AN “AS IS”, “AS AVAILABLE”, AND “WITH ALL FAULTS” BASIS. LEMONMD DISCLAIMS ALL EXPRESS OR IMPLIED CONDITIONS, REPRESENTATIONS, AND WARRANTIES OF ANY KIND. TO THE FULL EXTENT PERMITTED BY LAW, LEMONMD IS NOT LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES (INCLUDING, WITHOUT LIMITATION, LOSS OF BUSINESS, REVENUE, PROFITS, GOODWILL, USE, DATA, ELECTRONICALLY TRANSMITTED ORDERS, OR OTHER ECONOMIC ADVANTAGE) ARISING OUT OF OR IN CONNECTION WITH THE SITE, EVEN IF LEMONMD HAS PREVIOUSLY BEEN ADVISED OF, OR REASONABLY COULD HAVE FORESEEN, THE POSSIBILITY OF SUCH DAMAGES, HOWEVER THEY ARISE, WHETHER IN BREACH OF CONTRACT OR IN TORT (INCLUDING NEGLIGENCE), INCLUDING WITHOUT LIMITATION DAMAGES DUE TO: (a) THE USE OF OR THE INABILITY TO USE THE SITE OR (b) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SITE, INCLUDING WITHOUT LIMITATION UNAUTHORIZED ACCESS TO OR ALTERATION OF TRANSMISSIONS OR DATA, MALICIOUS OR CRIMINAL BEHAVIOR, OR FALSE OR FRAUDULENT TRANSACTIONS; OR (c) CONTENT OR INFORMATION YOU MAY DOWNLOAD, USE, MODIFY, OR DISTRIBUTE.

If you are dissatisfied with any Content of the Site, or with any of the Terms, your sole and exclusive remedy is to discontinue using the Site.

THE ONLINE PRIVACY POLICY

LemonMD has created this privacy policy because we are committed to protecting your privacy.  The following discloses our information gathering and dissemination practices for the Site:

LemonMD’s servers log certain information each time You access a file, including your IP address, the name of the file, the date and time of the request, whether the request was successful, the computer operating system and web browser that you use, and any extra data appended to the end of the request.  LemonMD use this information to help diagnose problems with the server, to administer the Site, and to communicate with you after you have sent us e-mails.

LemonMD may send small files called “cookies” to your web browser to help us collect and analyze aggregate information about visitors to the Site.  This information is not linked to a user name, and does not reveal your individual identities and preferences.  LemonMD uses this information to measure the number of visitors to various pages of the Site.

The Site includes links to other external websites. Those sites may have different privacy policies.  If you access another website through the Site, we encourage you to read the privacy policy of that website, which will usually be posted on the website. LemonMD is not responsible for the privacy policies of other websites, or whether the owners or operators of those websites will abide by their privacy policies.

If you engage in activities such as spoofing, spamming, the posting of libelous, slanderous, defamatory, or infringing materials, or unlawful acts, LemonMD may be required to disclose your name and other identifying information to our Site hosting provider or to government authorities.

If you provide posts or e-mail feedback about the Site, LemonMD may publish that feedback on our Site using your first name and last initial only.

LemonMD is developing the Site to meet your needs, and therefore reserves the right to modify this policy without advance notice. 

The Terms and the Online Privacy Policy constitute the entire agreement between you and LemonMD with respect to the use of the Site and Content.  The terms and policies described above are immediately effective, and replace all previous Terms and Policies.
